On 11th October 2023, the Department of Home Affairs opened a unique opportunity for corporate employers through the Trusted Employer Scheme (TES). The TES follows a recommendation from Operation Vulindlela, the team established in 2020 to support Cabinet and the President in accelerating the implementation of priority structural reforms.
What’s in it for employers? The TES will allow companies seeking to employ skilled foreign labour to undergo advance vetting and approval. Once approved, the trusted employer gains access to a simplified route for hiring a predetermined number of skilled foreign nationals from outside the country, with reduced requirements for each visa application.
Admission to the TES scheme is granted on a points based system with the key criteria being:
a) Investment (made since 2018 or pledged at a South African Investment Conference) of at least R 100 million
b) Minimum of 100 staff, of which at least 60% must be South African citizens or permanent residents
c) Sector: company`s activity must fall within a priority sector as determined by the Department of Trade, Industry and Competition
d) Skills Transfer: proven systems and programmes for skills transfer to local staff
e) Employment equity compliance or equity equivalence agreement with the DTIC
