On Friday, 6 June, the Cape Town High Court apparently declared Home Affairs' Directive 9 of 2014 illegal, which would mean that persons who have applied for an extension or change of their permits and not yet received a result, and whose previous permit has already expired whilst waiting, could no longer be declared "undesirable" when leaving the country.
The information can only be confirmed once the court order has been released. The order will then have to be translated into a directive by Home Affairs and we are hopeful that this obviously illegal practice by the Department will stop soon.
