Persons awaiting the outcome of an application for temporary residence whose previous permits have in the meantime expired, should not leave the country! As per directive issued this Monday, they will be fined on departure in the same way as a person who has overstayed the length of their permit. On return, they will have to be in possession of a valid visa, or be visa exempt in order to be allowed back into the country. This rule has been made irrespective of the fact that Home Affairs'own processing times are still standing at 8-12 weeks and sometimes more, and that the law demands an application only 30 days prior to expiry of one's current status. IMCOSA is investigating and discussing this with senior officials, and we will keep you updated.
